Minimal calculation index and minimal wages

The Law of RK from December 5, 2023 № 43-VIII approved the Republican budget for 2024 – 2026, according to which from January 1, 2024 are established:

1) minimum wage – 85,000 tenge;

2) monthly calculation index – 3,692 tenge.

Mandatory pension payments by employers (OPWR)

Effective January 1, 2024, a 1.5% own account OPWR is introduced for the benefit of its employees (with a gradual annual increase to 5% by 2028). OPWRs are made only for employees born after January 1, 1975.

At the same time, the employee’s monthly income taken for the calculation of the WIRA must not be less than the minimum wage and must not exceed 50 times the minimum wage.

For tax agents who have chosen to pay the WUA as part of the single payment, the share of the WUA in the rate of the single payment from wages is 7%.

Special social payment for citizens employed in jobs with harmful labor conditions

Citizens, foreigners and stateless persons permanently residing in the territory of the Republic of Kazakhstan, employed in jobs with harmful working conditions, were entitled to a special social payment at the age of 55 years. Obligatory conditions for the appointment of special social payment are reaching the age of 55 and the presence of professional pension contributions to the Unified National Pension Fund for the last 7 years.

The payment is made until the retirement age (men – 63 years; women – 61 years).

The special social benefit consists of:

1) special professional state benefit;

2) insurance payment under a pre-retirement annuity insurance contract;

3) occupational payment at the expense of the employer’s funds

4) pension payment formed at the expense of mandatory professional pension contributions from the unified accumulative pension fund.

The amount of the special professional state benefit is monthly 2 values of the subsistence minimum (43,407 tenge).

The right to payments arises on the condition that the employee terminates employment in jobs with harmful working conditions or is transferred to another job that excludes exposure to harmful production factors.

Moratorium on business inspections completed

On January 1, 2024, the moratorium on business inspections was completed.

It was introduced from January 1, 2020 and established a prohibition for central state and local executive bodies of inspections and preventive control with visits to small businesses, including microentrepreneurship, except for inspections conducted on 14 grounds provided for by the Decree of the President of the Republic of Kazakhstan dated December 26, 2019 № 229 “On the introduction of a moratorium on inspections and preventive control with visits in the Republic of Kazakhstan”

Mandatory fingerprinting

Foreign citizens and stateless persons are required to undergo fingerprint registration when obtaining (among other things):

  1. temporary or permanent residence permits;
  2. residence permits, stateless person’s certificate for the first time or for its restoration, replacement of
  3. visas of the Republic of Kazakhstan.

Stage 3 of universal declaration

From January 1, 2024, the third stage of universal declaration is introduced, within which the Declaration of assets and liabilities (Form 250.00) must be submitted by managers, founders (participants) of legal entities and individual entrepreneurs, as well as their spouses.

Form 250.00 must be submitted to the state revenue authorities not later than July 15 – on paper, September 15 – electronically through the web-application “Cabinet of the taxpayer” (cabinet.salyk.kz) or mobile applications e-Salyq Azamat, eGov mobile, Halyk.

Failure to submit a declaration entails a warning, and in case of repeated violation within a year – 15 MRP.

Personal presence when obtaining an IIN

From February 23, 2024, it will be possible to obtain an Individual Identification Number (IIN) for foreign citizens only upon personal application to the State Corporation (SON). It will be impossible to obtain an IIN by proxy.

Currency control

Fulfillment of obligations to repatriate national currency under export-import contracts will be checked by state revenue authorities.

The inspection does not require the execution of an act on its appointment.

The inspection is carried out without visiting the inspected resident by sending him a written request to provide information and (or) documents related to the currency transaction, including the fulfillment of obligations under the currency contract on export or import.

For reference: export and import contracts with non-residents of the Republic of Kazakhstan, the amount of which exceeds USD 50,000 in equivalent, are subject to record registration in the authorized bank. Repatriation of national and (or) foreign currency on export or import consists in crediting to bank accounts in authorized banks:

1) proceeds in national and (or) foreign currency from exports;

2) national and (or) foreign currency transferred by a resident in favor of a non-resident for import settlements in cases of non-fulfillment or incomplete fulfillment of obligations by a non-resident.
