The President of the Russian Federation signed Federal Law No. 382-FZ dated November 9, 2024 on amendments to Part 1 of Article 5.42 of the Code of Administrative Offenses
This norm provides for liability for the employer’s failure to fulfill the obligation to create or allocate jobs for the employment of disabled persons within the established quota, as well as the refusal to hire within the quota.
Now for such offenses officials face a fine of 5 thousand to 10 thousand rubles.
From November 20, the fines for this offense will be increased and differentiated for officials, individual entrepreneurs and organizations and will amount to:
- for officials – from 20 thousand to 30 thousand rubles;
- for sole proprietorships – from 30 thousand to 50 thousand rubles;
- for legal entities – from 50 thousand to 100 thousand rubles.
As a general rule, employers with more than 35 employees have a quota for hiring disabled persons established by a regional act. This quota is 2-4% of the average number of employees. At the same time, a constituent entity of the Russian Federation may differentiate the size of this quota depending on the type of economic activity, municipalities and the average number of employees (Article 38 of Federal Law No. 565-FZ “On Employment in the Russian Federation” dated December 12, 2023).
