Simplified conditions for the registration of foreign IT specialists

As of 28.06.22, amendments were made to the Federal Law dated 25.07.2002 N 115-FZ “On the Legal Status of Foreign Citizens in the Russian Federation”.

For foreign specialists in the field of information technologies who have entered into an employment contract or a civil law contract for the performance of work (provision of services) with an accredited organization* carrying out activities in the field of information technologies (except for organizations with the status of a resident of a technology innovation special economic zone) and members of his/her family (spouse, children (including adopted children), spouses of children, parents (including adopted children), spouses of parents, grandparents, grandchildren):

• It is not required to obtain an Work permit / patent, as well as to issue a permit to the employer to attract and use foreign workers (and there are no specific positions);
• The residence permit is issued without prior obtaining a residence permit.
• The residence permit may be revoked by the HCNM (as an additional ground):
  • if within 30 working days from the date of termination of the TD (contract of employment) such specialist has not concluded a new similar contract with a similar organization;
  • if the state accreditation of such an organization has been revoked.

* The procedure for accreditation of such organizations is established by Decree of the Government of the Russian Federation of 18.06.2021 N 929 “On state accreditation of organizations carrying out activities in the field of information technologies” (together with “Regulations on state accreditation of organizations carrying out activities in the field of information technologies”)

The amendments also stipulate that in order to ensure national security, solve other tasks of domestic and foreign policy, the peculiarities of the legal status of certain categories of foreign citizens, which are temporary in nature, may be determined by decrees of the President of the Russian Federation.
